End User Licence Agreement
1. This agreement
This End User Licence Agreement ("the Agreement") is between you and Journeysoft ("we", "us"), the publisher of Secrets of the Ostari ("the Game"). It covers the Game, its online services (accounts, the Crossroads, game servers, chat, the Exchange, ladders) and any updates. By installing, signing in to or playing the Game you agree to it. If you do not agree, do not play the Game.
Our Privacy Policy explains what data we keep and why. It is part of this Agreement.
2. Your licence
We give you a personal, non-exclusive, non-transferable, revocable licence to install and play the Game for your own non-commercial entertainment, as long as you follow this Agreement.
We keep every right not expressly given to you. You do not own the Game, your account, or anything in it: heroes, items, gold, cosmetics, Siege Coins and other virtual items are part of the service we license to you.
3. The Game is in alpha
The Game is unfinished and is being developed in the open. That means:
- Features, balance and content will change, and some may be removed.
- Heroes, items, progress and other game data may be reset or deleted, for example when a new season starts or a bug forces it.
- There will be bugs, crashes, lost progress and server downtime.
- We do not promise that the online services will be available at any time, or that they will continue to exist.
4. Your account
An online account needs an email address you control. Keep your password private: you are responsible for what happens on your account. One account belongs to one person. You must be at least 13 years old (or older where the law of your country requires it) to make an account.
If you lose access, we may reset your password after checking that the account is yours.
5. Rules of play
You agree not to:
- use cheats, hacks, bots, macros that play for you, or modified game clients;
- exploit bugs for an advantage (please report them instead);
- reverse engineer, decompile, disassemble or get around the Game's protection, except where the law allows it regardless of this Agreement;
- attack, overload or interfere with our servers or other players' connections;
- buy, sell or trade accounts, items, gold or other virtual items for real money or anything outside the Game;
- pretend to be a member of staff or another player.
6. Community conduct
Chat, account names, hero names and game names are seen by other players. Do not harass, threaten or abuse anyone, post hateful, sexual or illegal content, spam, or share anyone's personal information. We may remove messages and names and take action under section 8.
7. Virtual items, cosmetics and Siege Coins
Gold, items, cosmetics, Siege Coins and other virtual items have no monetary value and cannot be exchanged for money. They are licensed to you, not sold. Cosmetics only change how things look; they never give gameplay power.
Anything you obtain is non-refundable, except where the law where you live says otherwise. If purchases are offered, the terms of the store you buy through also apply.
8. Enforcement
If you break this Agreement we may warn you, remove items or progress gained by breaking it, or suspend or close your account. Where it is needed to protect other players or the service, we may do so without notice.
9. What you send us
When you send us bug reports, feedback, chat messages or other content, you allow us to use it to run, fix and improve the Game. We do not have to use feedback, and we do not owe you anything for it.
10. Updates
The Game checks for updates when it starts and may download and install them. Online play needs the current version.
11. Other software
The Game is built with the Godot Engine (MIT licence, copyright Juan Linietsky, Ariel Manzur and contributors) and other open-source components, which are covered by their own licences.
12. No warranty
To the extent the law allows, the Game and its online services are provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not promise that the Game will be free of errors, secure, or available without interruption, or that your data will not be lost. You play at your own risk.
13. Health
A very small number of people may have seizures when exposed to flashing lights or patterns, including in video games, even with no history of them. If you or anyone in your family has epilepsy, talk to a doctor before playing. Stop playing at once and see a doctor if you feel dizzy, have blurred vision, eye or muscle twitches, or any loss of awareness. Take breaks.
14. Limit of liability
To the extent the law allows, we are not liable for indirect, incidental or consequential damages, for loss of data, progress or virtual items, for what other players say or do, or for services run by others (such as Discord and itch.io). Our total liability to you is limited to the amount you paid us in the 12 months before the claim, or 10 US dollars if you paid nothing.
Nothing in this Agreement limits liability that cannot be limited by law, or takes away rights you have as a consumer where you live.
15. Ending this agreement
You may stop playing at any time and ask us to delete your account (see the Privacy Policy). We may end your licence if you break this Agreement. Sections 7, 9, 12, 14 and 17 continue after it ends.
16. Changes
We may change this Agreement. When we do, we will update the version and date, and the Game will ask you to accept the new version before you can play.
17. Governing law
This Agreement is governed by the laws of the State of Arizona, United States, without regard to its conflict-of-law rules. Any dispute about it or the Game will be heard in the state or federal courts located in Arizona, unless the law where you live gives you the right to bring it in your local courts.
